SUNIX Privacy Policy

SUNIX Computer Consultants Pty Ltd, trading as SUNIX (we, us, our) provides practice management
software (Software) to optical businesses that licence our Software (Businesses).

Businesses use our Software to collect, store, use and disclose the health and transactions personal
information of their customers and patients (Customers), and otherwise run their businesses.
We are bound by, and committed to complying with our obligations under, the Privacy Act 1988 (Cth)
(Privacy Act) in relation to personal information. This Privacy Policy explains how we handle
personal information and how individuals can contact us regarding the personal information that we
hold about them.

Personal information

Personal information is information about an individual which identifies the individual, or from which
the individual can reasonably be identified, such as an individual’s name, contact details and
information about an individual’s health and transactions.

The types of personal information that we typically collect include:

  • Businesses: Names, contact details and records of our dealings with Business personnel; and
  • Customers: Businesses usually store all the information that they collect about their
    Customers in our Software. That will often include Customer names and contact details,
    information relating to Customer eye health, the services they provide to Customers, and
    Customer transactions, including any Medicare and private health insurance reimbursements.

Why we handle personal information

We handle personal information of Businesses and our other business contacts, and the personal
information of Business Customers for the following purposes:

  • to conduct business, and otherwise interact, with Businesses and our other business contacts
  • to provide our Software to Businesses, through which they collect, hold, use and disclose the
    personal information of their Customers
  • to provide Businesses and our other business contacts with information about our products
    and services that may be of interest to them
  • any purpose required or permitted by law
  • any purpose disclosed to an individual and to which then have consented
  • any purpose that individuals would otherwise reasonably expect, and
  • otherwise to run our business.

The only circumstances in which we may access the personal information of the Customers of
Businesses is incidentally, for the purpose of system administration or providing technical support to
those Businesses, or when requested by a Business in respect of the data of that Business only.

Collection of personal information

We only collect personal information by lawful and fair means. By far the most personal information
that we “collect” is information of the Customers of Businesses, when they upload that personal
information to our Software.

We also collect the personal information of Business personnel and our other business contacts in the
course of our business dealings with and for them.

Disclosing personal information

We do not access Customer personal information except for the purpose of system administration or
providing technical support to a Business. We do not disclose it, except to our contractors on a
confidential basis, for the purpose of system administration or providing technical support to a
Business. We never disclose Customer personal information for any business development purpose,
such as marketing or promotions to Customers. We do not sell or rent any Customer personal
information.

We may disclose personal information of Business personnel and our other business contacts in
situations such as:

  • working with our service providers, including IT services, insurers, mailing houses
  • working with our professional advisers, including lawyers, accountants and auditors, and
  • when required to do so by government, regulatory and law enforcement authorities.

Accessing and correcting personal information

If you wish to gain access to, or seek correction of, the information that we hold about you, you may
contact us on the details provided below. If we refuse access, we will provide you with a written
notice explaining our reasons for refusing access and the provisions of the Privacy Act on which we
base our refusal. We may seek to recover reasonable costs incurred for providing you with access
the personal information that we hold about you.

If you believe that the personal information we hold about you is inaccurate, outdated, incomplete,
irrelevant or misleading, you can contact us on the details provided below to seek correction. We are
not obliged to correct any of your personal information if we do not agree that it requires correction
and we may refuse to do so. If we refuse, we will provide you with a written notice explaining the
basis for our refusal.

Security of personal information

We hold personal information in both paper-based and electronic files. Electronic information
collected through the SUNIX eVue system is stored on a secure third party server within Australia.
Information recorded on the SUNIX Vision system is stored or hosted by the Business. We seek to ensure
that personal information that we hold is protected from misuse, interference and loss caused by
unauthorised access, modification or disclosure. Our employees and agents are obliged to treat any
personal information held by us confidentially.

Direct marketing

We may use the personal information of Business personnel and our other business contacts,
including their contact details, to provide them with information about products and services that may
be of interest to them.

Neither we, nor our business associates, use the personal information of Business Customers for
marketing or business development purposes.
